Whereas on the 21st day of January in the year 1845 JOHN STONE as executor of
the last will and testament of SPENCER STONE deceased filed his bill in
chancery in the Lincoln Circuit court against SMITH STONE, ELIAS B. STONE,
CALEB STONE, SILAS STONE, NANCY MONTGOMERY late NANCY STONE, POLLY COLLIER
late POLLY STONE, LUCINDA FOREMAN late LUCINDA STONE, GEORGE A. FORMAN her
husband, *CATHERINE LEACH late CATHERINE STONE, WILLIAM MONTGOMERY and
MARGARET his wife late *MARGARET STONE, *SAMUEL M. STONE and LUCY his wife,
THOMAS J. MONTGOMERY and SARAH his wife, late *SARAH STONE, *SILAS A. STONE,
MARTIN KNOWLES and MENECE his wife, late *MENECE STONE, JESSE KNOWLES and
NANCY his wife, late *NANCY STONE, *THOMAS A. STONE and JANE his wife, ASA
KNOWLES and DORCUS his wife late *DORCUS STONE, JOHN B. SMITH and JEREMIAH B.
SMITH and John Rout and such proceedings were had in said suit that at the
June term of the Lincoln Circuit court 1847 a decree was pronounced --- the
heirs of SPENCER STONE deed to convey to the defendants JEREMIAH B. SMITH and
JOHN B. SMITH the tracts of land therein after described and inasmuch as a
part of the heirs of SPENCER STONE ceased are infants under the age of 21
years and a portion of the heirs of the said SPENCER STONE are adults and
reside out of the state of Kentucky, it was among other things decreed and
ordered that the said conveyance be made by a Comminsionery in Chancery on the
part of the heirs of SPENCER STONE deceased to the said JOHN B. SMITH and
JEREMIAH B. SMITH with clause of general warranty of Title upon their payment
of the sum of One Thousand Dollars which payment was acknowledged by the said
JOHN STONE to have been made as will and more fully appear by referring to the
decretal order which was made in the said suit in chancery at the September
term of the Lincoln Circuit court in 1847. Now in oursuance to the before
mentioned decree which was made at the June term of the Lincoln Circuit court
1847. This indenture of bargain and sale and conveyance made and entered into
between John Stone, Smith Stone, Elias B. Stone, Caleb Stone, Silas Stone,
Nancy Montgomery late Nancy Stone, Polly Collier late Polly Stone, Lucinda
Forman late Lucinda Stone, George A. Forman, Catherine Leach late Catherine
Stone, William Montgomery and Margaret his Wife late Margaret Stone, Samuel M.
Stone and Lucy his wife, Thomas Montgomery and Sarah his wife late Sarah
Stone, Silas S. Stone, Martin Knowles and Menece his wife late Menece Stone,
Jesse Knowles and Nancy his wife late Nancy Stone, Thomas A. Stone and Jane
his wife, Asa Knowles and Dorcus his wife late Dorcus Stone parties of the
first part by the said Thomas Helm commissioner as aforesaid and John B. Smith
and Jeremiah B. Smith parties of the second Bit. Witnesseth that the said
parties of the first part by the said Thomas Helm Commissioner as aforesaid
for and in consideration of the sum of money mentioned in said decree as paid
by the said John B. Smith and Jeremiah B. Smith the receipt which is hereby
acknowledged they the parties of the first part by the said Thomas Helm
commissioner as aforesaid have and by these presents bargain, sell and convey
unto the said John B. Smith and Jeremiah B. Smith and unto their heirs and
assigns forever the following tracts of land lying and being in the counties
of Boyle and Garrard on the waters of the Dix River, the first of which tracts
is bounded as follows to wit:

Beginning at 2 white oaks standing on the top of the Clift of Dix River
and corner to land formerly owned by Jacob Copeland thence down the river N87
W30 poles thence S47 W64 poles thence N40 W52 poles to 2 dogwoods thence S62
W23 1/2 poles crossing the river to a Black oak standing on the top of the
clift of said river thence S40 E72 poles to a dogwood and white oak thence
N85 E38 poles thence S40 E72 poles to a dogwood thence to the beginning
containing 48 3/4 acres. Also another tract of land which is bounded as
follows to wit:
Beginning at a black gum and hickory at Scarlett Smiths corner in Logans
line N87 E138 poles to a white walnut tree Smiths thence his line N47 E76
poles to a sugar tree on the banks of Dix River thence with said river as it
meanders N40 W96 poles thence S70 W137 poles to a hickory and white walnut on
the bank of the river thence south to Logans corner and with his line 80 poles
to the beginning containing by survey 100 acres. Also 100 acres of land being
part of a 200 acre survey lying on Dix River which was patented to Scarlett
Smith on the 2nd day of December 1785 which 100 acres of land was sold under a
decree of Lincoln Circuit Court upon the petition of Anderson Rice guardian
for William H. Smith aforesaid Scarlett Smiths heirs and purchased by SPENCER
STONE in his life time and which entire tract of 200 acres of land is patented
to the said Scarlett Smith is bounded as follows to wit:
Beginning at a large Spanish oak on Logans corner in Doughertys line
running thence with Daugherty line E34 poles to his corner on the clift of the
river to a locust and spanish oak thence down the river with its meanders N52
S83 [?] poles N40 E56 poles to a sugar tree on Stones corner on the bank of
the river thence with Stones line S47 W76 poles to his corner thence with his
line S87 W138 poles to a black gum and hickory in Logans line S21 poles to his
corner and sugar tree thence with his line W80 poles to a dogwood and sugar
tree thence with his line S103 poles to the beginning though one half of this
survey was conveyed by Scarlett Smith to Benjamin French and is not intended
to be embraced in this deed the only portion conveyed in this tract is that
part of the survey which was sold under the decree of the Lincoln Circuit
court in the lease of Scarlett Smith heirs and purchased by SPENCER STONE in
his life time as will more fully and at large appear by referring to the
record and proceedings in said suit which was decided by the Lincoln Circuit
court. To have and to hold the said tracts of land herein before described
unto the John B. Smith and Jeremiah B. Smith and unto their heirs and assigns
forever and the said parties of the first part by the said Thomas Helm
Commissioner as also hereby covenant to and with the said John B. and Jeremiah
B. Smith to warrant and forever aforesaid to the title to the said tracts of
land therein described against all manner of claims whatsoever, On testimony
whereof the said parties of the first by the said Thomas Helm Commissioner as
aforesaid have hereunto subscribed their names and affixed their seals this
28th day of January 1848.

The following notes were added by by Elizabeth Stone Carleson about 1976 to
Judi Vargas' aunt, Ruth Haupert Murphy:

* These were children of Spencers son Thomas A. Stone who was deceased at the
time of Spencers death. Thomas Stone Sr was Sheriff of Gibson County, Indiana
and died while in office. He died in 1822 while still young man.

Spencer Stone took the above Smith boys to raise at the death of their father
Scarlett Smith. Scarlett was a brother to Spencers wife Sarah Smith. He
bought the land to keep the church from taking it as that was a common
practice in those days for the church to take land from widows and orphans. At
Spencers death there was a suit to have the land returned to the boys at the
exact price Spencer paid for it.
